Tenant Disputes: Fix Them Sooner Rather Than as Bigger Problems Later
When you are in the business of renting out property, there will be times when you have disputes with your tenants from time to time. Some are going to be legitimate disputes, but others are going to be frivolous. Even though it takes work, keeping good tenants is obviously the best way to keep the income flowing smoothly on your investment. Following are some good tips on helping you solve disputes in an effective manner so you can keep your tenants without giving up more than you have to.
Know the Law
There are many legal requirements that pertain to the tenant/landlord relationship in your area. Most laws are written under the authority of the state while others are local laws, within the jurisdiction of the county or city. Either way, as a landlord, you have to abide by all the laws. Before you can respond to any complaints or attempt to solve a dispute, you have to be sure that you are obeying whatever law is applicable. Failing that, the tenant will just have another complaint.
Discuss It with Your Tenant
The best way to head off any difficult problem or dispute with your tenant is to sit down and have a discussion. As with most relationships, the reason most problems arise is simply communication failure. Explain your position, and let the tenant explain their position to you. Be calm about the subject so it doesn’t turn into a shouting match. Once you both understand each other, you might be able to get to an easy solution that is fair for both of the parties.
Get Help From a Professional Mediator
In the situation where there is a problem tenant or if you just think that any discussion will end up in a counterproductive argument, you can turn to a mediator to help. These are professionals that have experience helping solve difficult problems. They can often work the two of you straight to a satisfactory resolution or agreement.
Keep Good Records
An amicable settlement might not even be achievable in some cases, despite your best efforts. As a responsible landlord, though, you have to keep comprehensive records. Any argument, sad to say, can end up in a courtroom. Write things down each time you speak with the tenant and keep it filed away so you can find it if you need to. The more evidence you have collected on your side, the better chance you’ll have at winning what you want. As challenging as it is, using the court system is often a necessary part of being a landlord, and that system heavily relies on having good recordkeeping.
Hire a Lawyer
Before you go to court, let your lawyer talk with the tenant’s lawyer, or if none then with the tenant directly. Many times, allowing two lawyers to discuss the problem can be the best way to solve the problem. It might be good to save this for use as a final measure before taking it to court, however. If this technique is tried too early it might not work as well since there is less pressure to avoid having to go to court.
Tenant disputes are part of being a landlord. Disagreements are going to come up, and it is a foregone conclusion that sometimes the disagreements are going to get heated. If you can get it in control at the first sign of trouble, you can often reach an agreement before someone loses their cool.
